Terms and Conditions:

The ‘Promoter’ is Trust Tairāwhiti Ltd (Tourism).

1. The Trust Tairāwhiti Ltd (Tourism) promotion starts 16th June 2025 and finishes on 25^th July 2025.  A winner will be drawn by Wednesday the 30th July and contacted that week to make flight arrangements.
2. To enter, complete the online form hosted on the Tourism Gisborne website. By entering the Promotion, each entrant will be deemed to have accepted these terms and conditions and to have agreed to be bound by them.
3. The competition is open to residents of New Zealand only.
4. The Winter Escape prize must be used during the months of August, September, and October 2025 ( excluding Labour Weekend)
5. The winner will be randomly selected by Trust Tairāwhiti Ltd.
6. The major prize component of this event includes,

• Return flights from origin of choice in NZ to Gisborne & back. If deemed driving is a more realistic option, the driver will be compensated to the value of $400 in fuel vouchers. 
• 2 nights Accommodation at Tatapouri Bay Oceanside Accommodation
• Tickets for two to Dive Tatapouri
• Tickets to two to Morere Hot Springs
• $60 Dome Voucher 
• A rental car for the duration of time in region.

1. Valid identification may be required for the winner to prove that both are winners over 18 to redeem the prize.
2. No purchase is necessary to win or participate in the Promotion.
3. No responsibility can be accepted for entries not received for whatever reason.
4. The Promoter reserves the right to cancel or amend the competition, including the prizes, and these terms and conditions without notice because of circumstances outside of the Promoter’s control and if it is prevented or delayed in performing those obligations by an event of force majeure.
5. Prizes are as stated, and no cash or other alternatives will be offered. Prizes are not transferable.
6. The Promoter reserves to disqualify any entry or refuse to award a prize where false or misleading details have been given or where an entrant has behaved in a fraudulent or dishonest manner or otherwise than in accordance with these terms and conditions.   
7. The Promoter’s decision in respect of all matters to do with the competition will be final.
8. To the full extent permitted by law, Trust Tairāwhiti Ltd will not be liable to the winners in respect of any claim for any loss, damage or injury whatsoever (including, without limitation, any consequential, indirect special, punitive or incidental damages) or for any physical or mental injury suffered by the winner or accompanist as a result of in connection with the competition or by reason of the utilisation or application of any prize won in the competition.
9. By participating, entrants grant Trust Tairāwhiti Ltd exclusive permission to use their names, photographs, videos, voices and likeness in connection with the promotion being published and to be photographed, filmed and/or interviewed by Trust Tairāwhiti Ltd and that Trust Tairāwhiti Ltd may use their names and such photographs, videos and/or interviews for promotional, marketing and research purposes.
10. The entrant waives any claims to royalty, right and/or remuneration for such use.
11. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook, Instagram, or any other Social Network. You are providing your information to Trust Tairāwhiti Ltd and not to any other party.

Definitions:

Disqualified Participants

• All Trust Tairāwhiti employees, all employees of participating sponsors or promoters and/or anyone otherwise connected with the organisation and their Immediate Families.
• Immediate Families include spouses, grandparents, parents, children, and grandchildren, whether by marriage, past marriages, remarriage, adoption, co-habitation or other family extension.

Entry

• This promotion applies to the Trust Tairāwhiti Ltd in any medium – digital, radio and print.
• Trust Tairāwhiti Ltd reserves the right to exclude any person from participating in the promotion on reasonable grounds.
• Trust Tairāwhiti Ltd reserves the right to refuse to award any prize to an entrant who Trust Tairāwhiti Ltd decides (in its sole discretion) has violated the rules, gained unfair advantage in participating in the promotion or won using fraudulent means.
• Personal information provided at the time of entry is presumed to be true and, in the case of email notification – active, through to and beyond the date of the Promotion’s completion.

Winning the Prize

• Only the person who originally entered the promotion can be awarded the prize (the Winner).
• The Winner is determined by the Promoter who shall for this purpose be deemed the judge (the Judge). The Judge’s determination of the Winner will be final, and no correspondence will be entered into.
• The Winner will be notified by phone and/or email. Where attempts to contact the Winner fail (e.g. when the Winner cannot be contacted by phone after three attempts or no reply to email notification) the Judge will select another winner. If, after successful notification, the prize is not confirmed within five days of being announced it will be regarded as forfeit. 
• No other family members, friends, office associates or any other person will be able to participate on the Winner’s behalf. In the event that the prize specified in the Promotion becomes unavailable for any reason, the Promoter may substitute a prize of a like or equal value

Travel/Accommodation

• Where the Prize includes domestic air travel and/or accommodation:
• The Winner and their travelling companion (if applicable) must travel together at all times. The Winner is responsible for transport from their residence to their nearest airport for flight departure.
• Any changes to travel dates or additional accommodation outside the travel period specified in the prize details, made by the Winner, which incur additional costs, are to be paid by the prize Winner.
• Unless explicitly stated, the Winner will be responsible for expenses including, but not limited to, spending money, meals, drinks, taxi services, laundry charges, incidentals, gratuities, service charges, travel insurance and all other ancillary costs associated with redeeming the prize. The Winner must obtain travel insurance to protect themselves against additional costs incurred in the event of unforeseen circumstances.
• Prize must be taken as stated and no compensation will be payable if the Winner is unable to use the prize as stated. For the avoidance of doubt, if the Winner is, for whatever reasons beyond the Winner’s control or otherwise, then the Winner will forfeit the prize.
• The Promoter makes no representation as to safety, conditions and other issues that may exist at any destination. The Winner accepts the prize at their own risk.
• All travel is subject to the terms, conditions and restrictions of the prize service providers. Any travelling companion included in the prize (if applicable) accepts the prize subject to these terms, conditions and restrictions as if references to the Winner in the relevant clauses were to the travelling companion. The Winner and their travelling companion must sign a legal release, in a form acceptable to the Promoter in its absolute discretion, if requested by the Promoter. 

Trust Tairāwhiti Ltd Responsibility

• Trust Tairāwhiti Ltd reserves the right to amend, vary, extend or discontinue a Promotion at a stage, for any reason.
• To the fullest extent permitted by law Trust Tairāwhiti Ltd will not be liable for any loss or damage whatsoever (including but not limited to direct or consequential loss) or for personal injury as a result of Promotion entry or winning the prize.

Acceptance

• Participation in the Promotion is deemed acceptance of these Terms and Conditions.
• If the Winner does not accept these Terms and Conditions, the prize will be forfeited.
